I think it is a jolly good thing that I am reading law.
It hasn't been easy. Life was never busy before but it is now, but I feel I am headed in the right direction. I know a lot more than I did. aww and very excitingly I should be getting a new court shoe and new-beg-kerja in a few days! nah, getting butterflies just thinking about it! ha :)

I wonder if anyone has considered working/ drafting for 20 hours a day? that's what boss is doing now. poor man but he is a great counsel!

Muslims have under Article 11(1) the freedom to profess, practice and propagate the Islam religion in its widest connotation. Besides, under Article 11(3) the Muslims, collectively or in distinct identifiable groups have the right, like non-Muslims, to manage their own religious affairs, institutions, property etc. This extends to establishing or maintaining institutions for educating their children in Islamic religion.

Thus, it must borne in mind that, the declaration in Article 3(1) does not constitute the Federation (which includes state) a body to determine or prescribe what Islam is or which of its variant doctrines , tenets and principles shall be practiced by Muslims or what their children should be educated in, and this provision does not derogate from Muslim’s freedom of religion (exercised individually or in group, privately or in public) which they would otherwise have had, like the non-Muslims, but for this provision.


Therefore, so-what if Dr Asri is a Wahabi? He is now professing an open-minded school of Islam. I suppose Islam is an ad-deen (way of life) and not only confined to ritual and ceremonies. In the case of Meor Atiqulrahman Bin Ishak & Ors v Fatimah Bte Shili & Ors (2000) 1 CLJ 393, the High Court at page 402 therein stated,

“ Islam ialah ugama bagi Persekutuan tetapi ugama-ugama lainboleh diamalkan dengan aman damai bermakna Islam adalah ugama utama di antara ugama-ugama lain yangdianuti di Negara ini seperti Kristian, Buddh, Hindu dan selainnya. Islam bukan setaraf dengan ugama lain, bukan duduk berganding bahu atau berdiri sama tegak. Ia duduk di atas, berjalan dahulu, terletak di tempat medan dan suaranya lantang kedengaran…”


In Mohamed’s Imam’s Article title “ Making Law Islamic In Malaysia: A Constitutional Percepive reported in [1994] 2 CLJ vii has succinctly summarized the position of Islam under Article 3(1) of the Federal Constitution as follows :

“Article 3(1) is not a mere declaration but imposes a positive obligation on the Federation to protect, defend, promote Islam, and to give effect by appropriate state action to the injunctions of Islam, and enable, facilitate and encourage Muslims to order lives and practice according to Islamic injunctions, spiritual and mundane alike.”


Again, in the case of Lina Joy v Majilis Agama Islam Wilayah Persekutuan & 2 Others (2007) 3 CLJ 557, the court further confirmed that,

" Islam tu bukan sahaja suatu himpunan dogma-dogma dan ritual-ritual tetapi ianya adalah juga suatu cara hidup yang lengkap merangkumi semua bidang aktiviti manusia, persendirian atau awam, perundangan, politik, ekonomi, sosial, budaya, moral atau kehakiman...."


Yes, I suppose every Muslim should obey the injunctions of the Quran and Sunnah in all their facets because Muslim will to be judged accordingly by Allah on the Day of Judgment and Islam is / should not retricted to rituals only. It is ought to be interpreted in a wider perspecitive, i.e. as way of life, so, who are those 35 Jais officials and over 20 armed policemen in patrol cars to decide on the matter of Dr Asri’s conscience?
